<p>Here is the summary of the ruling:</p>
<p><em>&#8220;Present at the hearing on contempt today&#8217;s date were the plaintiff, Lesli Cohen, and her attorney, James Donnelly, and appearing by telephone, the co-plaintiff, William Hue. The defendant, Aaron Brown and Siroque Holdings as well as the Rule 19 party, Paul Kimmage, were not present. This Court finds that actual notice was given to the defendant&#8217;s representative in Court, and that notice was sent to the last known address of Aaron Brown and Siroque Holdings.</em></p>
<p><em>After hearing the Court finds as follows: Effective January 16, 2014 Justice Robert Gordon of this Court issued an order which basically enjoined the defendants from disbursing any funds from the Paul Kimmage Defense Fund, requiring that they identify the location of banks and account numbers where the funds were currently held, and also providing an accounting of each prior donation to and disbursement from the account.</em></p>
<p><em>The latter two parts of the order were to be complied with by February 25, 2014. The Court finds that this order was clear, unequivocal and quite simple in its terms and furthermore, that it was signed by each party or their representative as of January 31, 2014.</em></p>
<p><em>The Court credits the representations of counsel and finds that the defendants did not respond in any fashion to the order, that they produce identifying information regarding the accounts, regarding Paul Kimmage Defense Funds at any time subsequent to the order. This is also borne out by the docket of this matter which was admitted as an exhibit.</em></p>
<p><em>The Court also credits the testimony of Lesli Cohen who received information from at least two donors that they received a refund of a portion of their donations to the fund during the month of March 2014 in direct disobedience of the Court order.</em></p>
<p><em>The Court also finds that the specific notations on Exhibit three to the effect that, “a small group of U.S. donors is trying to block the refunds” indicates that the defendant was aware of the Court order and willfully violated it.</em></p>
<p><em>Accordingly, this Court concludes that there is clear and convincing evidence that the defendant violated a clear and unequivocal order to provide information regarding the whereabouts of the funds and not to make disbursements.</em></p>
<p><em>As a result the Court will enter judgment on these consolidated complaints for contempt in favor of the plaintiff, Lesli Cohen and William Hue. Pursuant to this judgment the Court further orders that the defendant, Aaron Brown and Siroque Holdings, comply with the order of January 31, 2014, forthwith in that the defendant Aaron Brown and Siroque Holdings pay Lesli Cohen her costs and attorney&#8217;s fees in the amount of $11,169.16 as specified in amended Exhibit six.</em></p>
<p><em>The Court will set a thirty day deadline for compliance with this order and will entertain a motion for further sanctions if strict compliance is not had by August 8, 2014.</em></p>
<p><em>Is that clear?&#8221;</em></p>
<p>A final Pre-Trial Conference date has been set for October 10, 2014, at which time all parties are required to attend. If Aaron Brown fails to comply and fails to appear, it is highly likely that the court will rule in favor of me, Bill Hue, and Paul Kimmage and assess full damages (the full value of the missing Kimmage Defense Fund, as well as legal costs for a year and a half of litigation) against Brown and Siroque Holding, and enter a final judgment against Aaron Brown that will be entered into United States legal records. This will set a precedent for future litigation in other countries against Aaron Brown, should anyone else wish to pursue him internationally.</p>
<p>We&#8217;ll keep you updated as to any further developments.</p>

<p>Suffice it to say, from September of 2012 until March of 2013, things seemed to be humming along for Cyclismas, and I was filled with hope and optimism that even the little people could have a powerful voice in the world of cycling, and I was giddy that I was one of them.</p>
<p>Exactly one year ago, I was finalizing travel plans to head to England to launch the Trek-Cyclismas Pro Commute Team project. It was an ambitious and innovative concept hatched at the London Bike Show in January of 2013 – to sponsor a team of ordinary people who cycled to work as if they were a &#8220;professional&#8221; team of commuters and outfit them like a pro cycling team. They&#8217;d have bikes, kit, a DS, training camps, and &#8220;races.&#8221; The goal was to demonstrate through humorous short videos, blogs, photos, and other social media that cycling to work was not only a viable transportation option, but that it could be awesome and fun. More people on bikes. Cool, huh?</p>
<p>It&#8217;s funny how quickly things can change. Less than a month later, I discovered that my business partner was also the biggest con-artist in the cycling industry, and everything I had been working on for over two years was built on a web of lies and deceit. The TCPCT project was hanging in jeopardy, with the money to fund it now disappeared. My credibility as an editor of a website largely based on the writings of a liar was questioned. The people who had come on board to work with us had no financial security (and, as it would turn out, no scruples). Advertisers and project partners bailed on us. And I became the principal in a lawsuit that was going to end up costing me more money in total than had been raised to defend Paul Kimmage in his fight against the UCI&#8217;s and Pat McQuaid&#8217;s and Hein Verbruggen&#8217;s specious defamation lawsuit.</p>
<p>In a knee-jerk moment of defiance, anger, stubbornness, and sheer stupidity, I decided to personally (and when I say personally I mean with the financial support from my husband&#8217;s lifetime savings) continue funding Cyclismas, its remaining staff, and the TCPCT project. I foolishly believed certain people when they told me they would be able to bring in new advertisers and make Cyclismas not only self-sustaining, but also successful. So I paid salaries. I paid for travel. I paid to bring the entire TCPCT team to Flanders to &#8220;Commute the Classics&#8221; and get interviews, video footage, and more to help promote the project. I took the Cyclismas crew to the 100th edition of the Tour de France. I supported two guys for five months with salaries that were better than what your average BBC producer makes.</p>
<p>And I got royally screwed.</p>
<p>I have nothing to show for the bulk of my investment in 2013, except for a really cool bunch of Instagrams, a tiny chunk of the pavé from the Arenberg, some Strava segments from riding up Rocacorba, Mt. Ventoux and Alpe d&#8217;Huez, and a picture of Michelle Cound in the hotel elevator holding up Chris Froome&#8217;s sparkly maillot jaune from the final night on the Champs-Élysées. I have no website content, since pretty much all of my contributors have upped sticks and moved on to greener pastures, and I have no sponsors, no income, and no staff – as they decided to fuck off with my money, my equipment, all the Road Reel shows and interviews we produced, and start their own venture. Now how does that adage about &#8220;fool me once&#8221; go again…?</p>
<p>Oh, but I have memories. Memories of starting a group ride up Mt. Ventoux with Paul Kimmage, Dave Smith and Justin Pickens, only to have them drop my ass within the first mile out of Bedouin and let me spend the remaining three hours toiling up the mountainside all by myself. Memories of arriving in Alpe d&#8217;Huez all ready to ride that epic climb only to discover that my &#8220;friends&#8221; had neglected to pack my gear from our stay in Valreas and I didn&#8217;t have any cycling shoes or a helmet. Memories of feeling like a wallet with legs and not much more for pretty much the entire trip.</p>
<p>But it all looks so fucking awesome on my resumé.</p>
<p>Fast forward to today. I can&#8217;t take any more. I&#8217;m done trying to swim against the tide and try to make something out of this festering pile of bad memories and heartache. I&#8217;ve had my last disappointment. The Trek project is officially dead. People who promised to help did their best, but in the end the lure of more lucrative and enticing ventures has pulled them away. Derek, my most stalwart supporter and the person who made me think I could still make something of this venture, has thrown in the towel out of utter disappointment that in spite of his best efforts, it&#8217;s just not going to happen. I don&#8217;t blame him, he&#8217;s not getting paid for this, and all of the perks he was promised never materialized.</p>
<p>So if he&#8217;s done, I&#8217;m done. I can&#8217;t do this alone, and frankly I don&#8217;t want to. I&#8217;m not going to spend all of my time trying to nurture a website known for nothing now but a few sporadic articles that I can coax and cajole out of friends, and a podcast that probably won&#8217;t be happening for much longer anyway. I have to be realistic. People have lives to lead, jobs to do, teams to run. And I&#8217;m not getting any younger.</p>
<p>So this is goodbye. Farewell Cyclismas. You were one hell of a roller coaster ride.</p>

<p>Kent is a fascinating character in the world of cycling, as this <a href="http://www.thebicyclestory.com/2010/11/kent-peterson-issaquahs-favorite-car-free-ultra-long-distance-racing-techie-turned-mechanic/" target="_blank">profile of him by The Bicycle Story reveals</a>. Not only is he a cyclist, a bike mechanic, and an adventurist, he&#8217;s a cycling advocate, he and his family have lived car-free for over two decades, and he once held the single speed record for the 2,000+ mile Great Divide Mountain Bike Race.</p>

He&#8217;s now seeing first-hand that there are a lot of guys out there with talent, guys for whom many teams either don&#8217;t have a slot for them, or don&#8217;t have a huge budget to pay a great salary. And the fact that Creed can&#8217;t hire or help out a lot of these guys is really killing him.</p>
<p>We do these podcasts because they are a labor of love. Because he is a bit of a of a podcast junkie, a radio interview show is something Creed has wanted to do for a long time. And I&#8217;m flattered and thrilled that he approached me to help him realize that dream, not least of which is because we&#8217;ve become such good friends in the process of producing 20 shows this year.</p>
<p>The fact that Colorado Cyclist is sponsoring them and RoadID underwrote the episode with George Hincapie is immaterial to whether or not Mike continues to do these shows. Don&#8217;t get me wrong, their support is amazing, and we love them for wanting to help us keep bringing the shows to the listeners. It&#8217;s not a lot of money, but it gives us a few dollars to maybe get a better microphone so you don&#8217;t get all that echo when Creed is recording in GarageBand, or to help pay for the gas to let him drive to meet Levi in Santa Rosa. But when we started them, Creed just wanted to talk to people and make a podcast. It&#8217;s really for him, more than for any audience, although they&#8217;ve evolved to the point of self-awareness with a life of their own, much like HAL (hope you all get that movie reference). That you guys can eavesdrop on Creed&#8217;s conversations is a gift, it&#8217;s the icing on the cake. But we didn&#8217;t start out thinking that the podcasts were going to be something to try to make money. We were actually pretty adamant at the beginning that they not be sponsored so that it was about the purity of the experience, and Creed had the freedom to say what he wanted and his guests did too.</p>
<p>And even though this is a nominally commercial venture I&#8217;m trying to run here with the site, let&#8217;s be honest. It&#8217;s less about the money and more about the ability to have a voice, do something out of the ordinary, and make a difference.</p>
<p>So here&#8217;s the thing. Instead of spending the sponsorship money on equipment or gas and tolls, or putting it in our negative-balance bank account, we want to put it into a fund for those guys I was just telling you about. You can call it a stipend fund, a development grant, a hand-up, lunch money, a free pull, gap assistance, it&#8217;s on us, we got it, whatever. But some of these young kids are earning well below the poverty level trying to break into the ranks of pro bike racing, chasing the dream that one day they might be racing in the big leagues and pulling down a reasonable salary. But until that happens, a lot of them are quite literally starving on their meager wages.</p>
<p>Imagine if you&#8217;re one of those guys or gals. And if someone handed you a hundred bucks at a race to cover your meals. That would be pretty sweet, right? Well, we&#8217;d like to do that for three or four racers a month during the season. Just a little something extra to keep them going when it seems pretty lean for them.</p>
<p>We&#8217;re not quite sure how this is going to be implemented just yet, as we were literally just talking about it earlier in the day. And we&#8217;re hoping for some feedback from all of you to help us shape this seedling of a plan and help grow it into a mighty thing for good. Something pure and helpful, a way to give back. That sly little shove to the saddle when the commissaire isn&#8217;t looking that helps get you over that tough climb.</p>

Jessie Walker made a big step up in 2013 and we believe she is capable of very big things now. She demonstrated her quality in professional stage races in France last season, and with a year of being a full time athlete, we only see her getting stronger.”</p>
<p>The team will also retain Mel Lowther, Jo Tindley, and Harriet Owen along with World Champion Corrine Hall. Mel sustained injuries following a bad crash in early season but recovered well to win the national junior scratch championships in September  “Despite being young Mel has battled through injury with great maturity to get back into shape and ended up becoming a major attacking force in Elite races,” commented Wyman.  “She’s only a first year junior and with a good winter under her belt we know she can challenge the best in the UK.”</p>
<p>“Harriet and Jo are sprint focused and both riders the have been exceptional this year. They are very fast and are a dynamic combination when they get the opportunity. We will work very hard during the off season to ensure we have the best lead-out train possible for these two fast finishers.  Harriet was a World Championship silver medalist and is a classy bike rider who understands instinctively how racing works.  Jo has become a captain of the team in what has been a transition year for her as she climbs back to the top of the sport.”</p>

<p>The team has also added four new British riders with very different roles. Penny Rowson returns to the team after a year away so already has a good understanding of how the team operates and the expectations within the team.  Penny was placed 2<sup>nd</sup> in the National U23 Road Race championships in 2012 and brings experience to the team who will be working hard to help her return to the same form very quickly.</p>
<p>Bethany Hayward, who has just returned from the World Junior Road Race Championships, will join the squad and add significant firepower to the climbing section of the squad.  Last season Beth was a constant threat in any race with a hill, and as a young rider the team will be looking to develop this strength. In an outstanding season culminating in 20<sup>th</sup> place at the Junior Worlds, Bethany was the overall winner of the Essex Giro 2 Day, and was on the podium in the National Junior Championships.</p>
<p>Louise Borthwick joins as an all-rounder, a rider that had an impact on the UK scene last year and her strong, aggressive attacking performances led her to a string of stand out performances in what was a breakthrough year.  Her ride in the Johnson Health Tech GP in Woking caught the attention of a lot of people. Louise was able to back up her strong showing throughout the season. The team also sees the potential for Louise to make the Commonwealth Games squad for Scotland.</p>
<p>Recognising the legacy of London 2012 the team has also added Para-Cyclist Lora Turnham, World Champion in the tandem road time trial with Corrine Hall.  Corrine and Lora are one of the youngest Para-Cycling partnerships, and could find themselves in a dominant position in the sport with more of the hard work they put in during 2013.</p>
<p>”Lora is a signing that makes me very happy and it’s going to be great to see what Corrine and Lora can do in 2014 to back up their World Championship ride,” added Wyman</p>
<p>The final signing for the team is the first overseas rider to join the team for several seasons. Sigrid Jochems from Holland, who finished 4<sup>th</sup> in the Sparkassen Giro (UCI 1.1) in 2013, will join the team and add further power to the teams sprint train.  Having left the sport to pursue her other passion, gymnastics for several years, Sigrid made a strong comeback to the sport in 2013 and has her eyes firmly set on a professional contract for 2015.</p>
<p>“Sigrid has huge experience and actually rode for my team a few years ago.  I know exactly what I’m adding to the squad here and I couldn’t be happier.  Sigrid is one of the fastest finishers I have ever seen in women’s cycling and has a natural ability to position herself in the peloton. Our team can all learn from Sigrid during 2014 and over this coming winter.  With The Women’s Tour being based in the East of England, we know Sigrid could be a key signing for us,” concluded Wyman</p>

<p><b>What the riders say: </b></p>
<p><b>Louise Borthwick:</b> &#8220;I am really excited about joining Matrix Fitness for the 2014 season and I’m looking forward to working with the team to achieve success in what will be a big year for women’s cycling in the UK. Next year I’m aiming to build on what I have achieved this year in British domestic races as well as gaining experience of stage races on the Continent. I’m sure I can benefit from the experience of Stef and the other Matrix riders which will help me develop to my full potential.”</p>
<p><b>Corrine Hall:</b> 2013 was a great year for me. My dream of becoming a World Champion became a reality and I was able to balance my GB and Matrix Fitness commitments well.  Following the successes of this year, I&#8217;ve become a full bike time rider and I&#8217;ll be looking to step up my performances once again.  It&#8217;s very exciting to be staying with Matrix as the environment is ideal for me to achieve my goals.  I&#8217;ve even been involved in development meetings with the teams’ sponsors for 2014, which is something totally new and exciting for me.</p>
<p><b>Bethany Hayward:</b> I&#8217;m really excited to be riding for Matrix next year. It’s a great set up and a really good group of riders. Being a junior it’s a perfect opportunity to get into such a well-established team with more experienced riders and we’ll be looking forward to new challenges together.  I would like to do well in some stage races next year, particularly Bedford 3 Day.  I did well in the Essex Giro this year and I’d also like to go one better from 2013 and try to win the Junior National road champs.</p>
<p><b>Sigrid Jochems:</b> I&#8217;m very excited to race with Matrix in 2014.  We have been in discussion for some time and it&#8217;s always been something I wanted to happen.  I rode for Stefan in the past with Global Racing so I have a great understanding of the team. I took a long break from the sport but recently returned and had a great 2013.  I now want to go ahead and back up my results with good performances for Matrix in the UK with the potential of the Tour of Britain and the Johnson Health Tech GP races something I have heard a lot about.</p>
<p><b>Mel Lowther:</b> I am really excited about going into my second year with Matrix Fitness, moving up from a youth last year was a big step and the team supported me amazingly. I am looking forward to continuing working with them and meeting my new teammates.</p>
<p><b>Harriet Owen:</b><b> </b>2013 saw the peloton come up against a top rider in phenomenal form in Hannah Barnes.  She was hard to beat, but that certainly made us raise our standards and I know we will be much stronger in 2014. I think strong riders like Louise can help make the team very fast at the finish and I&#8217;m really looking forward to riding with them.</p>
<p><b>Jo Tindley:</b> 2013 was a tough transition year. I expect a lot from myself, but the professional support of the team has helped me grow as a rider and I feel ready to start winning bike races in 2014. I took on a captaincy roll in the team and I enjoyed it working with the younger riders. I&#8217;m going to keep doing that but hope to be showing them how to win from the front next season.</p>
<p><b>Lora Turnham:</b> I am very excited to be part of Matrix Fitness. I have never ridden for such a professionally-run team and relish the experience. Both myself and Corrine have had fantastically successful years and hope that working with Matrix Fitness will only help to further our successes. I also hope that being part of Matrix Fitness will help continue raising the profile of paracycling in this country.</p>
<p><b>Jessie Walker:</b> This is my 3<sup>rd</sup> year with the Matrix team and I’m so pleased to be a part of it all.  It’s the most well established team in the UK which is very reassuring as historically teams have come and gone. The team keeps growing every year so the prospect of next year is very exciting.</p>
